This Privacy Policy pertains to the provision of ticketing services by E & S Staples Pty Ltd (ACN 081 195 440) trading as TicketHost ("TicketHost"). The policy is based on the Privacy Act 1988, the Privacy Amendment Act 2001 and the National Privacy Principles contained therein. Collection of Your Information

TicketHost collects information of a personally identifiable nature via the website www.tickethost.com.au for the purpose of performing our ticket sales hosting services. TicketHost is the sole owner of all information collected on the website. In order to purchase tickets through TicketHost you must provide accurate information such as name, mailing address, email address and phone number.
In some instances, additional information is collected on behalf of the event organiser to facilitate the effective administration of the event.
TicketHost may also collect and analyse website traffic information to evaluate the performance and effectiveness of our systems and enhance our service levels.
TicketHost collects order information at this website and then passes you to a secure page hosted by ANZ Bank eGate Transaction Server for collection of credit card details. Credit card information is not captured, stored or transmitted by the TicketHost website.

Use and Disclosure of Your Information

The personal information we collect is used to:

  • effectively satisfy your request for tickets
  • allow us to report ticket sales to the event organiser
  • allow the event organiser to effectively administer the event
  • execute delivery of your purchased tickets
  • allow us to contact you if we experience difficulties in processing your order
  • advise you wherever possible of cancellation/changes to the event you have booked

TicketHost may access the credit card information collected and stored by the ANZ Bank in order to allow:

  • TicketHost to process refunds
  • Event Holders to perform proof of purchase identification

All access to credit card information for these purposes will be via the ANZ Bank's secure Merchant Administration website.

In addition, contact information collected from Event Holders may be displayed on the website in order to facilitate communication and query management from prospective Ticket Buyers. Ticket Buyers and Sellers will receive emails relating to their purchases and sales. Buyers may also opt to receive event notification emails from specific Event Holders. Buyers and Sellers may also opt to receive special offer emails from TicketHost. You may amend your selected email options at any time via the website or by contacting TicketHost. Your personal information will not be disclosed to a third party except when:

  • it is necessary to process your transactions with us, for example in delivering your tickets via a shipping company.
  • you authorise the disclosure
  • it is required for the purpose of investigating a reasonably suspected illegal activity that has been or may be committed.
  • we are obligated to do so by a Court or government regulation
  • it is determined by TicketHost to be necessary in order to prevent a serious health or safety threat

Aggregate information may also be provided to third parties, however this data will not contain any personally identifiable information.

Cookies

A cookie is a small text file automatically transferred to your computer by a website for various reasons. TicketHost like many others websites uses cookies to assist in recognition of returning users, monitor site activity and enable processing of orders. This website utilises Javascript and Session Cookies extensively to manage interaction with users of the website. To use the features of this website including order processing it is a requirement that your web browser is set to accept Cookies and has Javascript enabled.

Security

TicketHost will take reasonable measures to maintain your data in a safe and secure manner. You are solely responsible for ensuring the confidentiality of your TicketHost User Id and Password. You are solely responsible for all authorised or unauthorised access to the TicketHost website by any person using your User Id and Password. You must report any unauthorised use of your User id and Password to TicketHost immediately.

PayPal

The Paypal Acceptable Use Policy described here is incorporated into these terms of use under these conditions:

  • For an Event Organiser when the Event Organiser elects to offer PayPal as a payment method for their event OR
  • For a Ticket Buyer when the Ticket Buyer opts to process a payment through the PayPal system

TicketHost uses reasonable efforts to ensure the accuracy of information provided on the website however TicketHost does not guarantee the accuracy of information, the suitability of products, or anything else. TicketHost does not promise that the website will be uninterrupted or without error. The website and all goods and services provided by TicketHost come on an "As-Is" and "As-Available" basis. TicketHost makes no guarantee of any specific result from use of this website or use of any TicketHost service and does not guarantee that the website will meet Seller's or Buyer's purposes. TicketHost does not ensure that any emails or files originating from the website will be free of viruses or any destructive elements. TicketHost disclaims to the fullest extent permitted by applicable law any warranty, express or implied, including, without limitation, any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will be enforced to its full effect. This agreement is governed by the laws of Victoria, Australia and you irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia. TicketHost acts as an agent for and on behalf of the person or organisation presenting the event ("Event Holder"). As such all claims are the sole responsibility of the Event Holder and to the extent permitted by law, TicketHost has no liability to you.

Sales Information

  • All ticket prices are shown in Australian dollars and are inclusive of GST if GST is applicable.
  • Available methods of ticket delivery or collection will be offered when placing your order. It is your responsibility to choose a method to ensure that tickets are delivered or picked up prior to your event. Neither TicketHost nor the Event Holder are able to offer any guarantee of the estimated delivery times.
  • Where concessions are offered the associated conditions will be shown separately on the website. Appropriate proof of entitlement must be provided to gain admission.
  • If the amount you pay for a ticket is found to be incorrect then TicketHost has the right to cancel that ticket and refund the amount paid. This will apply irrespective of whether the error was a result of human error or a malfunction of the TicketHost website.
  • If you do not receive email confirmation of your purchase or you receive an error notification after submitting your order payment, it is your responsibility to confirm with TicketHost whether or not your order has been successfully placed.

General Terms and Conditions

  • A ticket is a revocable license to attend an event. Admission may be refused upon refunding the ticket's original value. A ticket is not redeemable for cash.
  • The Event Holder reserves the right to change, reschedule or cancel a scheduled performance.
  • No refund or exchange on any ticket is permitted except as required by law or as specified by the Event Holder. If a refund is processed, TicketHost may retain any fee it has charged.
  • The Event Holder reserves the right to alter venues, prices, seating allocations and attendance capacity.
  • The right of admission to an event is subject to the Event Holder's and the Venue's terms of admission.
  • Certain items may be restricted from entry including but not limited to alcohol, food, cameras, video cameras, recording devices and knives.
  • The right to refuse entry is reserved if tickets are damaged or are not purchased from TicketHost or another authorised ticket seller.
  • The Event Holder and Venue Management reserve the right to refuse entry to latecomers or defer entry until a suitable break in the performance.
  • A search of person and personal possessions may be a required condition of entry. If you do not consent to such a search you may be refused entry to the event without refund or compensation.
  • TicketHost is entitled to charge a fee for the replacement of tickets.
  • Without the prior written consent of TicketHost and the Event Holder tickets may not be resold at a premium or used for other commercial purposes. Tickets sold or used in violation of this condition, may be cancelled without refund and the ticket holder refused admission.
  • By purchasing a ticket to an event you assume all risks incidental to the event, whether before, during or after the performance of the event.
  • The Event Holder reserve the right to refuse admission or eject, any person whose conduct is deemed disorderly, who uses vulgar or abusive language or who fails to comply with Event Holder rules. Breach of terms or rules will terminate your license to attend the event without any liability for refund.

TicketHost reserves the right to change this agreement at any time and notify you by posting the updated version on our website. Any changes will come into effect immediately upon posting to the website unless otherwise specified. If you make a purchase after these changes have occurred you agree to be bound by the amended agreement.

Miscellaneous

This Ticketing Services Agreement is between E & S Staples Pty Ltd (ACN 081 195 440) trading as TicketHost ("TicketHost") and you a person, partnership or corporate body authorised to grant access to an Event ("Event Holder"). By registering as a Ticket Seller at the TicketHost website you represent that you have read and understood this Agreement, the Website Terms of Use Agreement and the Privacy Policy and agree to be bound by all Terms and Conditions contained therein.

Agency

  • TicketHost is hereby appointed as the sole Australian agent for online ticket sales for the events offered by the Event Holder to TicketHost.
  • TicketHost is authorised by the Event Holder to retain a hosting fee per ticket sold and other fees as listed in the TicketHost Pricing Schedule or otherwise agreed by the two parties.

Services and Responsibilities

Under the terms of this agreement, TicketHost will provide the following services:

  1. List the Event Holder's offered events on the TicketHost website.
  2. Process online orders and payment for tickets to the Event Holder's events.
  3. Provide a report of all tickets sold to the event and all fees charged by TicketHost.

Under the terms of this agreement, the Event Holder has the following responsibilities:

  1. Provide TicketHost with valid and accurate event information including comprehensive details of any applicable sale or admission restrictions.
  2. To honour and fulfill all ticketing commitments for tickets to their events validly issued by TicketHost.

Ticket Sales and Fees

  • TicketHost will offer the event tickets for sale on it's website using the prices, venue capacities, seating allocations, categories and terms advised by the Event Holder.
  • For each event, TicketHost and the Event Holder will agree the ticket delivery methods that are permitted and where applicable any additional delivery fee that TicketHost is to charge.
  • The Event Holder is solely responsible for the configuration of the TicketHost Event System settings for their events. In the event that TicketHost staff setup or assist with the setup for an event, the Event Holder is responsible for ensuring that the configuration is correct.
  • All fees are inclusive of GST and a tax invoice for all of the fees retained by TicketHost is to be provided to the Event Holder not more than 10 business days after the final performance date of the hosted event.
  • TicketHost may authorise designated Event Holder Users to process cash sales via the TicketHost website. If an order is processed as a cash sale, the Event Holder accepts full responsibility for order payment and TicketHost is not liable for remitting any monies in relation to tickets on that order.
  • The Event Holder is solely responsible for the payment of any GST applicable to the ticket sales made by TicketHost on behalf of the Event Holder.
  • TicketHost may offer to host an Event Holder's event without charging a hosting fee. This offer is at the sole discretion of TicketHost and is subject to reasonable use criteria.

Security of Ticket Revenue

  • Ticket revenue received by TicketHost on behalf of the Event Holder is deposited directly into the TicketHost Client Funds bank account.
  • Ticket revenue will be held in the Client Funds account until the Event Settlement takes place, not more than 5 business days after the final performance date.
  • The Event Holder at all times retains entitlement to ticket revenue held in the Client Funds account for their event, with the exception of:
    • Hosting and Delivery fees
    • Ticket refund and chargeback amounts
    • Amounts subject to dispute by ticket purchasers
  • At Event Settlement, the ticket revenue due shall be remitted to the Event Holder together with a statement describing all financial transactions for the event.

Refunds, Re-Schedules, Cancellations and Chargebacks

Individual Refunds

It is the Event Holders responsibility to authorise and issue refunds to individual ticket buyers, although TicketHost may at it's discretion assist with issuing the refund. Hosting and delivery fees included in the original sale transaction will be charged to the Event Holder.

Event Re-Schedule

If an event is re-scheduled for any reason and a ticket holder cannot attend the new date, the ticket holder is entitled to a full refund. TicketHost will process the refund, hosting and delivery fees included in the original sale transaction will be charged to the Event Holder.

Event Cancellation

If an event is cancelled for any reason all ticket buyers are entitled to a full refund. TicketHost will process the refunds, hosting and delivery fees included in the original sale transaction will be charged to the Event Holder.

Chargebacks

All credit card chargebacks initiated by ticket buyers will be charged to the Event Holder. The chargeback will be deducted from the ticket sales remittance or in the event that the remittance has already occurred TicketHost will send an invoice to the Event Holder for the chargeback amount.

Interim Payments

TicketHost may at it's discretion offer to remit a portion of the ticket sales revenue to the Event Holder prior to the event date as an Interim Payment. In the event that such an Interim Payment is made, the Event Holders acknowledges and accepts that they are liable for issuing all ticket buyer refunds applicable to that ticket sales revenue.

Termination of Agreement

This Agreement may be terminated:

  • at any time by either party after giving 7 calendar days written notice to the other party.
  • by the Event Holder immediately by notice if TicketHost becomes bankrupt or enters into a deed of arrangement with creditors or becomes incapable of performing it's agents services or commits a fundamental violation of this agreement.
  • by TicketHost immediately by notice if the Event Holder becomes bankrupt or enters into a deed of arrangement with creditors or becomes incapable of performing it's function as an event holder or commits a fundamental violation of this agreement.

If the agreement is terminated for any reason, any incomplete events will be immediately removed from the TicketHost website event listings.

Indemnity

The Event Holder hereby indemnifies TicketHost against any claim that may arise from the sale or offer of sale of tickets to any event or cancelled event hosted by TicketHost under the terms of this agreement.

TicketHost reserves the right to change this agreement at any time and notify you by posting the updated version on our website. Any changes will come into effect immediately upon posting to the website unless otherwise specified. If you continue to use the TicketHost service after these changes have occurred you agree to be bound by the amended agreement.

Miscellaneous

  • To enable the supply of tickets TicketHost may provide the Event Holder with ticket buyer's personal information. In processing this information the Event Holder:
    • is bound by the TicketHost privacy policy and accepts all liability for any breaches of this policy.
    • accepts all liability for any breaches of the Spam Act 2003.
  • Event Holder's personal information may be provided to third parties by TicketHost only for the purpose of reasonable identity check requirements.
  • In listing an event TicketHost may utilise images and other content provided by the Event Holder. The Event Holder is responsible for ensuring that such images and content are free from copyright or trademark restrictions and is solely liable for any copyright or trademark infringements.
  • It is the responsibility of the Event Holder to confirm that the event configuration on TicketHost is correct, whether such configuration was created by the event holder or by TicketHost staff on behalf of the event holder. TicketHost will not be responsible for any losses or liability incurred as a result of errors or omissions in the event configuration on TicketHost.
